IS SAME-SEX MARRIAGE UNDER ATTACK AND WHAT SHOULD WE DO?
The U.S. Supreme Court’s potential reconsideration of Obergefell v. Hodges raises questions for same-sex couples in Massachusetts contemplating travel, education, or relocation to states that might revoke marriage recognition. While Massachusetts would continue recognizing same-sex marriages regardless of federal rulings, couples should prepare for legal complexities in states reactivating pre-2015 bans.
Legal Landscape
Same-sex marriage remains federally protected under the 2022 Respect for Marriage Act, which mandates interstate recognition of valid marriages (23). However, 35 states retain inactive bans that could resume enforcement if Obergefell is overturned (3). These include Southern, Midwestern, and Western states like Texas, Ohio, and Montana (3). The Supreme Court’s 2022 Dobbs decision heightened concerns about revisiting precedents, though legal scholars note Obergefell’s stronger equal protection rationale compared to Roe v. Wade (13).

Proactive Measures
While the Respect for Marriage Act provides a safety net for existing marriages, its limitations underscore the value of meticulous legal preparation (23). Consulting a family attorney familiar with LGBTQ+ rights in both origin and destination states remains advisable (45).

Finances & Insurance
- Taxes: Couples filing jointly in Massachusetts might face state income tax complications in states that disregard their marriage (4).
- Inheritance: Non-recognition states could deny spousal inheritance rights without explicit wills or trusts (5).
- Insurance: Employer-sponsored health plans may cover spouses nationwide, but state-specific policies (e.g., auto, home) might exclude same-sex partners (4).
- Hospitals in non-recognition states may restrict visitation or decision-making authority without healthcare proxies (5).
- Employer-based health coverage for spouses should remain intact under federal law, but Medicaid eligibility could vary by state (4).
- Non-biological parents risk losing custody rights in states refusing to acknowledge same-sex adoptions (4).
- Carry certified adoption decrees and consider second-parent adoptions in Massachusetts before relocating (5).
- Wills, trusts, and advance directives are critical to ensure asset distribution and medical wishes are honored (5).
- Update beneficiary designations for retirement accounts and life insurance policies (5).
Proactive Measures
- Legal Documents: Draft partnership agreements, co-parenting plans, and durable powers of attorney (5).
- Travel Preparation: Carry marriage certificates, adoption papers, and healthcare directives (35).
- Resource Consultation: Review guidance from Lambda Legal on interstate protections and contingency planning (5).
While the Respect for Marriage Act provides a safety net for existing marriages, its limitations underscore the value of meticulous legal preparation (23). Consulting a family attorney familiar with LGBTQ+ rights in both origin and destination states remains advisable (45).

WHat does a pride flag represent?
A flag is a visible symbol of community and unity. A pride flag shows acceptance and support of people who are lesbian, gay, bisexual, transgender, queer, intersex, asexual, and more (LGBTQIA+). These flags help people who have not always been treated kindly or fairly feel seen and welcome, and they remind us that our community is enhanced by including lots of different people.
What Is the Intersex-Inclusive Progress Pride Flag?
The Intersex-Inclusive Progress Pride Flag is a newer pride flag designed in 2021 by Valentino Vecchietti. This flag builds on earlier pride flags to include even more people. It has the traditional rainbow stripes, which stand for hope and the diversity of the LGBTQIA+ community as represented by Baker in 1978: red (life), orange (healing), yellow (sunlight), green (nature), blue (serenity), and violet (spirit). The flag also features a chevron (an arrow shape) on the left side with black and brown stripes (to honor people of color and those lost to HIV/AIDS) and pink, blue, and white stripes (for the transgender community) 1,2,3,4.
The newest addition is a yellow triangle with a purple circle inside it. These come from the intersex flag, created by Morgan Carpenter in 2013. Yellow and purple are used because they are not linked to being male or female. The circle stands for wholeness and the right of intersex people to make decisions about their own bodies 2,3,5.
What Do Different Pride Flags Represent?
There are many pride flags, each with its own meaning:
Why Are Pride Flags Important?
Pride flags are important because they help people feel accepted and respected for who they are. They show that everyone deserves kindness and understanding, no matter who they love or how they identify. Displaying these flags can help reduce fear and promote a welcoming community for all 4,6.

What Do Different Pride Flags Represent?
There are many pride flags, each with its own meaning:
- Rainbow Flag: Created in 1978 by Gilbert Baker, this is the most famous pride flag. Each color has a meaning: red (life), orange (healing), yellow (sunlight), green (nature), blue (serenity), and violet (spirit) 1,4.
- Transgender Flag: Made by Monica Helms in 1999, it has blue, pink, and white stripes for boys, girls, and those outside the gender binary 5.
- Bisexual Flag: Designed by Michael Page in 1998, it uses pink (same-gender attraction), blue (different-gender attraction), and purple (attraction to more than one gender)1,5.
- Asexual Flag: Black, gray, white, and purple stripes stand for asexuality, gray-asexuality, sexuality, and community 5.
- Intersex Flag: Created in 2013 by Morgan Carpenter, it’s yellow with a purple circle, showing wholeness and gender neutrality 3,5.
- Nonbinary Flag: Yellow, white, purple, and black stripes represent people outside the male/female system, those with many genders, both, or none 5.
Why Are Pride Flags Important?
Pride flags are important because they help people feel accepted and respected for who they are. They show that everyone deserves kindness and understanding, no matter who they love or how they identify. Displaying these flags can help reduce fear and promote a welcoming community for all 4,6.
